| Title: | A dosimetria das multas por infração às normas de defesa do consumidor: uma proposta em busca de efetividade |

| Abstract (native): | A presente tese tem por escopo o estudo acerca da dosimetria da sanção de multa aplicada pelos PROCONs, consubstanciado na tutela administrativa de consumo, regulado pelo Decreto Federal 2.181/1997 que institui a organização do Sistema Nacional de Defesa do Consumidor e as normas gerais de aplicação das sanções administrativas. A pesquisa aborda acerca da organização do Sistema Nacional de Defesa do Consumidor, coordenação e implementação da política nacional de relações de consumo bem como o poder de polícia e a competência concorrente dos órgãos integrantes do sistema. Visa a explorar criticamente, portanto, a falta de dosimetria objetiva do artigo 57 do CDC e a ponderação dos fornecedores em relação ao cumprimento ou descumprimento da penalidade de multa administrativa impostas pelos PROCONs. A tese tem a pretensão de fornecer os elementos necessários para o diagnóstico da omissão legislativa presente no artigo 57 da Lei 8078/90 e a indicação de soluções para a maior efetividade na aplicação da sanção de multa pecuniária imposta pelos PROCONs. |
| Abstract (english): | The present thesis aims to study the dosimetry of the fine sanction applied by PROCONs, embodied in administrative consumer protection, regulated by Federal Decree 2,181/1997 that institutes the organization of the National Consumer Protection System and the general rules of application administrative sanctions. The research addresses the organization of the National Consumer Protection System, coordination and implementation of the national consumer relations policy, as well as the police power and concurrent competence of the bodies that make up the system. It aims to critically explore, therefore, the lack of objective dosimetry of article 57 of the CDC and the weighting of suppliers in relation to the compliance or non-compliance with the administrative fine penalty imposed by PROCONs. The thesis intends to provide the necessary elements for the diagnosis of the legislative omission present in article 57 of Law 8078/90 and the indication of solutions for greater effectiveness in the application of the penalty of monetary fine imposed by PROCONs |
