Title: El derecho fundamental de participación política en España y Brasil : una perspectiva comparada

Abstract (native): O direito fundamental de participação política é considerado motor da legitimação do exercício do poder no Estado Democrático de Direito. Sua adequada regulação constitucional e concreção legal contribui, em grande medida, para a legitimidade global do sistema democrático. Neste marco teórico primário inserem-se as vigentes cartas constitucionais da Espanha - CE 1978 e do Brasil - CF 1988, que formalmente instituíram democracias participativas. A prática democrática, não obstante, volta-se de maneira desproporcional para a representação política, o acarreta na redução do exercício da democracia direta e semidireta a um plano funcional marginal. Este desequilíbrio entre representação e participação é causa da atual crise de legitimidade que afeta ambos os sistemas políticos. Nesta linha de raciocínio, o objetivo principal da presente Tese é analisar a crise de legitimidade institucional e social que afeta o sistema político do Brasil e da Espanha. O trabalho organiza-se em cinco Capítulos estruturados seguindo a técnica analítica do direito comparado. A metodologia utilizada é a revisão bibliográfica, jurisprudencial e legal que conformam o direito fundamental de participação política. Uma minuciosa análise do regime que diz respeito à estrutura e funcionamiento interno dos principais agentes do modelo democrático instituído na CE 1978 e CF 1988 - os partidos políticos possibilita que a discussão jurídico-constitucional se nutra de uma perspectiva inovadora e calcada em um olhar prático. Como resultado final, o trabalho propõe um conjunto de reformas legais para superar o atual panorama de crise institucional de ambos os sistemas políticos. Considera-se, entre outras questões, a imperiosa necessidade de executarem-se reformas legais que possibilitem: a) Reforçar a eficácia material do direito fundamental de participação política; b) Estabelecer um marco normativo que, com base no princípio de democracia interna, garanta a existência de procedimentos eletivos verdadeiramente democráticos no interior dos partidos. Adota-se, como perspectiva transversal, que um sistema democrático autenticamente participativo requer tanto um direito de participação política materialmente eficiente quanto uns partidos que promovam a participação nas suas estruturas eletivas e decisórias internas.
Abstract (english): The fundamental right to political participation arises as the mechanism to legitimate the exercise of empowerment in a state governed by the Democratic Rule of Law. Appropriate constitutional regulation and legislative development appears to be conditio sine qua non for the practical exercise of popular sovereignty by citizens. Under this theoretical model, both the 1978 CE and the 1988 CF are included, besides being recognised as constitutional texts boosting participatory democracies. Practical democracy, however, is highly balanced towards political representation. The exercise of direct and semi-direct democracy a factor never to be considered as secondary in a participatory democracy is reduced to a residual functional sphere. This imbalance between representation and participation is a direct cause for today s crisis on legitimacy affecting both political systems. Under this thinking trend, our aim goal is to analyse the institutional crisis of legitimacy that affects both political system in Spain and Brazil. The current research is organized in five chapters, following the analytical method of comparative law. The technique used is highly composed by the bibliographical, jurisprudential and legal review conforming the fundamental right of political participation. Moreover, the exhaustive analyses of the internal structure and the functioning of the main actors of the democratic model established in both the CE 1978 and CF 1988 the political parties permits the constitutional discussion to endorse an innovative practical perspective. As a final result, this research proposes an extensive group of legal reforms allowing: a) The reinforcement of the material efficiency of the fundamental right of political participation; b) The establishment of a legal framework that, based on the internal democracy principle, makes possible the existence of truly democratic internal proceedings in political parties. It is understood, as a transversal point of view, that a truly participatory democratic system requires both a highly efficient fundamental right of political participation as well as a party model that promotes the participation of the members in the internal electives and decision-making structures.
