Medidas cautelares pessoais alternativas à prisão e a (im)possibilidade da detração

Abstract

Through the study of doctrine and jurisprudence, we identified the theses that offer a solution to the problem created by the legislator by including precautionary alternatives to imprisonment without saying how their length of compliance should be considered in the sentence. Searching for similarities or identity between alternative precautionary measures and penalties, their compliance regimes and conditional release, and then observing whether the responses of each thesis respect all the principles that regulate the matter, we come to the conclusion that in that comparison we find several similarities and identities , however, due to the degree of restriction to the status libertatis that each entails, we believe that it should be considered in the detraction, as a mitigating factor or criterion of art. 59, CP, depending on the injunction and, in some situations, it will depend on the specific case.
