| Título: | A garantia dos direitos humanos internacionalmente consagrados e sua inserção no ordenamento jurídico brasileiro |

| Resumo: | A presente dissertação analisa a natureza das normas internacionais de direitos humanos e sua garantia no ordenamento jurídico brasileiro. Desenvolve o estudo sobre a inserção no ordenamento jurídico brasileiro das normas internacionais dos direitos humanos, sob o domínio do direito internacional dos direitos humanos. Inicia com a abordagem sobre a natureza das normas internacionais de direitos humanos, identificando a tendência atual de reconhecimento do seu caráter de imperatividade (jus cogens) e gerador de obrigações erga omnes, que impõe aos Estados o dever de cumprirem seus compromissos com o ser humano, superando o tradicional princípio da reciprocidade. O Brasil está inserido, tanto no sistema internacional, como também, no sistema regional americano, o que lhe impõe a obrigação de inserir no seu ordenamento jurídico as normas de garantias de proteção aos direitos humanos. A partir da disposição constitucional, analisam-se os caminhos do labirinto jurídico que se impõe diante do disposto no texto original de Constituição e a reforma oportunizada pela EC nº 45. Conclui, então, que o ordenamento jurídico brasileiro, com a recente modificação, não oferece uma garantia eficaz e segurança jurídica plena de proteção, restando fragílima a força normativa dos direitos humanos, ao possibilitar uma hierarquização entre os tratados internacionais de direitos humanos. |
| Abstract: | The present thesis analyzes the nature of the human rights international standards and their guarantee in the Brazilian legal system. It develops a study about the inclusion of the human rights international standards in the Brazilian legal system under the control of the human rights international law. It begins approaching the nature of the human rights international standards and identifying the present trend of recognizing its imperativeness feature (jus cogens) that causes erga omnes obligations and imposes the States to carry out their obligations with the human being and to overcome the traditional principle of reciprocity. Brazil is included both in the international system as in the American regional system, and this fact imposes the country the obligation to include in its legal system the guarantee standards of protecting the human rights. From the constitutional provision, the paths of the legal labyrinth that imposes itself before the provisions in the original text of the Constitution and the reform created by the EC nr. 45 (Constitutional Amendment 45) are analyzed. It concludes that the Brazilian legal system, with the recent change, does not offer an effective guarantee and full legal security of protection, causing the human rights legal power to become very weak, since it enables the human rights international agreements to be arranged in a hierarchy. |
