| Title: | A proteção do patrimônio cultural no Brasil e em Portugal, e da necessidade de implementação de um estatuto do patrimônio cultural brasileiro |

| Abstract (native): | A tese em apreço aborda o regime de proteção do patrimônio cultural, no Brasil e em Portugal, examinando os mecanismos de defesa, questionando a sua suficiência e propondo a necessidade do incremento do sistema de tutela, como também a construção de uma codificação das normas brasileiras, dentro de um compêndio próprio, cujo corpo esteja destinado especificamente para que se erija uma rede de promoção e proteção eficiente do bem jurídico em pauta. Dividido em três tomos, o estudo examina os mecanismos protetivos do patrimônio cultural no direito brasileiro, passa pelo emprego dos instrumentos de ordem penal e finda com a análise do regime de proteção do direito português, em nível de princípios, de direito constitucional, civil, administrativo e penal. Ainda, traça um comparativo das virtudes do ordenamento lusitano em relação ao brasileiro e preconiza apontamentos para a aproximação entre ambos, no sentido de que, em território nacional, possa ser construída uma tutela mais digna e eficaz do patrimônio cultural, a qual especialmente passaria pela sistematização das normas esparsas e pelo estabelecimento de um estatuto único e próprio da matéria. |
| Abstract (english): | The present thesis analyses Brazilian and Portuguese cultural heritage legal systems of protection, from examination and questioning of the sufficiency of the defense mechanisms established by each country. In addition, it will be presented some proposals with the aim of improving the Brazilian body of law about this subject, including the creation of one Code of Cultural Heritage thought in favor of its promotion and protection. The work is divided into three volumes, all of them based in constitutional, civil, administrative and criminal principles and structures. The first one examines the law about cultural heritage protection in Brazil. In sequence, it studies the use of criminal law to boost that indicated goal and finalize studying its protection system according to Portuguese law. Furthermore, it compares the Portuguese and the Brazilian law system about cultural heritage, indicating points for their approximation, more specifically for a future new regulation in the latter country. As a conclusion, it will be sustained the necessity of a better systematization of current law, from by the establishment of its proper code. |
