Processos administrativos ambientais : a sistematização da tutela do ambiente na esfera administrativa

Abstract

This thesis deals with the environmental administrative process. This research seeks to identify the uniqueness of administrative processes when related to the purpose of environmental protection. To do so, it examines the importance of administrative protection of the environment and the peculiarities of the administrative process as a legal institute. From the challenges of the administrative law and administrative process are experiencing because of the complexities and dynamics of the present days, it is proposed that the administrative process is perceived as a manifestation of the fundamental duty of environmental protection, which differentiates it to the ordinary administrative process. After the explanation of the assumptions on which the environmental administrative process should be organized, is proposed the systematization of the theme addressing their species, structure and peculiarities.
